As a service provider as defined in § 3 item 1, § 8 (1) of the Teleservices Law (14.12.2001) GS Engineering is responsible as defined in general law for information it holds for use. Links to content provided by other parties should be distinguished from GS Engineering own content. Content supplied by other providers transmitted via or stored in links is not the property of GS Engineering . Links are however always live (dynamic) references. The first time that the link is followed, GS Engineering reviews the other party's content to ensure that there are no potential issues with civil or criminal liability. According to the Teleservices Law, GS Engineering is not obliged as a service provider to monitor the information it transmits or stores nor to research circumstances which indicate illegal activity (§ 8 (2) Teleservices Law). If it is established or indicated by a third party that there are issues of civil or criminal liability concerning a specific product to which a link has been provided, then the link will be removed. The Teleservices Law defines the liability of the service provider as follows: GS Engineering shall not be liable for the transmission of information belonging to another party if GS Engineering (I) has not authorized this (II) has not chosen the addressee of the information transmitted and (III) has not selected or modified the information transmitted (§ 9 (1) Teleservices Law). GS Engineering is not liable for automatic, temporary storage of another party's information if it (I) does not modify the information, (II) observes the conditions relating to access to the information, (III) observes the rules for updating the information, which are defined in commonly recognized and used industry standards (iv) does not violate the permitted use of data capture technology to apply the information which is defined in commonly recognized and used industry standards and (v) acts immediately to remove or to block access to stored information as soon as it has been informed that the information has been removed from the network at the source of the transmission or access has been denied or a court or authority has ordered the removal or denial of access. (§ 10 Teleservices Law). GS Engineering is not liable for third-party content it holds for a user provided (I) it has no knowledge of illegal action or of the content and where there are claims for compensation for damages it knows of no facts or circumstances from which the illegal action or the information becomes apparent or (II) it immediately acted to remove or deny access to the information as soon as it acquired this knowledge.(§ 11 Teleservices Law) Legal note: All rights reserved.
